This Privacy Policy explains how TM Electric & Solar, operated by TM Electrical LLC ("TM Electric & Solar," "we," "us," or "our"), collects, uses, discloses, and protects information about you when you visit tm-electricandsolar.com (the "Site"), submit a form, call, text, or otherwise interact with our services. This policy is designed to meet the requirements of the California Consumer Privacy Act as amended by the California Privacy Rights Act (CCPA/CPRA), the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable 2026 U.S. state privacy laws, and to align with the General Data Protection Regulation (GDPR) for any visitors from the European Economic Area or United Kingdom.

We collect only the information we need to serve you. Specifically:

Information you provide directly — through our quote form, contact form, phone calls, SMS, or email:

  • Full name (first and last)
  • Phone number
  • Email address
  • Street address of the property where work would be performed
  • Business name (for commercial customers)
  • Services of interest, existing equipment, preferred schedule, estimated project scope
  • Any additional details you choose to share about your project
  • Your consent status for SMS and email communications

Information collected automatically when you visit the Site:

  • Pages visited, referring URL, time on site, click and scroll behavior
  • Approximate geographic location derived from IP address (city-level, not precise GPS)

Information we do NOT collect: Social Security numbers, driver's license numbers, precise geolocation, financial account numbers, health information, biometric data, or information about children under 13. This Site is not directed to children under 13, and we do not knowingly collect personal information from children.

2. How We Use Your Information

  • Service providers that help us operate the business — such as our lead management platform (GoHighLevel), Google Analytics, email delivery, hosting, and SMS providers. These vendors are bound by contract to use your information only to perform services for us and to keep it confidential.
  • Permit, inspection, and utility coordination — for example, sharing your property address with a building department or utility company when required for your project.
  • Legal compliance — when required to comply with a subpoena, court order, tax audit, licensing investigation, or other legal obligation.
  • Safety and rights — to protect against fraud, security threats, or harm to any person or property.
  • Business transfer — in the unlikely event of a merger, acquisition, or sale of assets, subject to the same commitments in this policy.

5. Cookies and Tracking Technologies

The Site uses a limited set of cookies and similar technologies to make the site work, to remember your preferences, and to help us understand how visitors use the site so we can improve it. Specifically:

  • Essential cookies — required for the Site to function.
  • Analytics cookies — Google Analytics 4 (measurement ID G-16F00RZP4Q) collects aggregated, anonymized traffic and event data (page views, form submissions, phone-click events) so we can understand which parts of the Site are useful. IP anonymization is enabled. We do not use Google Analytics data for advertising.
  • Search Console verification — a passive verification tag from Google Search Console.

You can disable cookies at any time in your browser settings. Doing so may affect some Site functionality. You can also install browser extensions like Google's Analytics opt-out add-on if you prefer not to be measured.

6. Your Privacy Rights

Depending on where you live, you may have the following rights regarding your personal information. TM Electric & Solar honors these rights for all customers, regardless of state of residence:

  • Right to access a copy of that information
  • Right to correct inaccurate information
  • Right to delete your information (subject to legal record-keeping obligations for permitted work and tax records)
  • Right to opt out of sale/sharing — already honored by default because we do not sell or share
  • Right to limit use of sensitive information — we do not collect sensitive information as defined by law
  • Right to non-discrimination — we will not deny you service or charge different prices for exercising your rights
  • Right to opt out of SMS — reply STOP to any text message

7. Data Retention

We keep your information only as long as reasonably necessary to serve you, comply with legal obligations (including CSLB contractor record-keeping and California tax records), resolve disputes, and enforce our agreements. Quote-request records for customers who never become clients are typically deleted within 24 months of the last interaction. Signed project records are retained for the period required by California licensing and tax law, typically seven years.

8. How We Protect Your Information

We use industry-standard administrative, technical, and physical safeguards to protect your information, including HTTPS/TLS encryption in transit, restricted access to customer records, and use of reputable vendors that maintain their own security programs. No system is 100% secure, and we cannot guarantee absolute security. If we ever become aware of a data breach affecting your information, we will notify you as required by California and federal law.

9. Do Not Track and Global Privacy Control

Because we do not sell or share personal information for advertising, there is nothing for a Do-Not-Track (DNT) or Global Privacy Control (GPC) signal to opt you out of. We still honor these signals to the extent they apply to any analytics or communication preferences.

10. Visitors from the EU/UK (GDPR)

If you are located in the European Economic Area, United Kingdom, or Switzerland, our legal bases for processing your personal information are: (a) your consent (for SMS/email marketing and analytics), (b) performance of a contract or steps to enter one (for quotes and service delivery), (c) compliance with a legal obligation, and (d) our legitimate interest in operating and improving the Site securely. You have the same access, correction, deletion, restriction, portability, and objection rights described in Section 6, plus the right to lodge a complaint with your local data protection authority.

The Site may link to external sites (for example, review platforms or manufacturer product pages). We are not responsible for the privacy practices of any third-party site. Please review those sites' own privacy policies before providing information to them.

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date above. If we make a material change to how we handle personal information, we will provide additional notice, such as a banner on the Site or a direct email if appropriate.
