These Terms of Service ("Terms") govern your access to and use of the website located at tm-electricandsolar.com (the "Site"), and any related services, content, quote requests, estimates, or communications (collectively, the "Services") provided by TM Electric & Solar, operated by TM Electrical LLC, a California limited liability company, holding California Contractor License #1021393 ("TM Electric & Solar," "we," "us," or "our"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, you may not use the Site or Services.
1. Who We Are
TM Electric & Solar is a licensed, bonded, and insured electrical and solar contractor headquartered at 1175 La Moree Road, San Marcos, CA 92078, serving San Marcos and North County San Diego. All contracting work is performed under CA Contractor License #1021393 and is subject to the rules of the California Contractors State License Board (CSLB).
2. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Services. By submitting a form or requesting an estimate, you represent that the information you provide is accurate and that you are authorized to request work at the property described.
3. Estimates, Quotes, and Site Visits
Any prices, ranges, or estimates presented on the Site or in initial written or verbal communications are informational only and do not constitute a binding contract or a fixed price. Final pricing is provided only after an in-person or virtual site assessment and will be documented in a written proposal or contract signed by both parties. Estimates may change based on site conditions, code requirements, utility coordination, permits, and scope changes requested by the customer.
4. Communications and SMS Consent
By providing your phone number and checking the consent box on any form, you expressly consent to receive communications from TM Electric & Solar via email, phone call, and SMS text message at the number provided, including messages sent by autodialer or prerecorded voice, regarding your quote, service, scheduling, and follow-up. Consent is not a condition of purchase. Message and data rates may apply. Message frequency varies. You may reply STOP at any time to opt out of SMS messages, or HELP for help. Opting out of SMS does not affect your ability to contact us by phone or email.
5. Payment Methods
TM Electric & Solar currently accepts cash and check only. Payment terms for each project are set out in the written contract or invoice. We do not accept credit or debit card payments through the Site.
6. Warranty and Workmanship
Warranty terms for electrical and solar work are provided in writing on a per-project basis as part of the signed contract. Manufacturer warranties on equipment such as panels, inverters, chargers, and batteries are provided by the equipment manufacturer and are subject to that manufacturer's terms and claim process. Nothing on the Site should be interpreted as an expanded or additional warranty beyond what is stated in your signed project contract or the manufacturer's terms.
7. Intellectual Property
All content on the Site — including text, logos, graphics, photographs, gallery imagery, videos, blog articles, and code — is owned by or licensed to TM Electric & Solar and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may view and share the content for personal, non-commercial purposes only. You may not copy, reproduce, modify, distribute, republish, or use the content for any commercial purpose without our prior written consent.
8. Third-Party Links and Services
The Site may contain links to third-party websites, tools, or services (including analytics, map providers, and marketing platforms). We are not responsible for the content, policies, or practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site's own terms.
9. No Guarantees on Informational Content

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TM ELECTRIC & SOLAR, ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SITE IS LIMITED TO ONE HUNDRED DOLLARS ($100). NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW. LIABILITY FOR SIGNED PROJECT WORK IS GOVERNED BY THE SEPARATE PROJECT CONTRACT AND CALIFORNIA CONTRACTORS STATE LICENSE BOARD RULES.
12. Indemnification
You agree to indemnify and hold harmless TM Electric & Solar and its owners, employees, and agents from any claim, damage, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site, violation of these Terms, or violation of any third-party right.
13. Governing Law and Disputes
These Terms are governed by the laws of the State of California, without regard to conflict of laws principles. Any dispute arising out of or related to the Site or these Terms shall be brought exclusively in the state or federal courts located in San Diego County, California, and you consent to the personal jurisdiction of those courts. Disputes arising under a signed project contract will follow the dispute-resolution terms of that contract.
14. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
